Buying a House in Guernsey

Compared with other jurisdictions, the process of buying a house in Guernsey is simple and fast. The transaction is normally concluded within four to six weeks of your offer being accepted.

The vendor’s estate agent provides the parties with a draft contract (conditions of sale) setting out the basic details of the transaction. The contract will be in the standard form approved by the Guernsey Bar.

We will advise you when it is the right time to sign the contract.

Ashton Barnes Tee Guernsey Advocates will investigate the title whilst you or your mortgage brokers agree the finance with the bank and you have your survey done.

By the time our searches are complete, the bank should have agreed the finance and instructed its advocates to confirm to us that the lending is approved. By then the vendor’s advocates should also have approved the conditions of sale and we will then see you to explain the title and for you to sign up.

From there we prepare the draft conveyance for approval by the other parties’ advocates and organise the payments to be made on completion whilst you organise your move.

On completion you come into the Ashton Barnes Tee office and we go over to the court where the Jurats witness your consent to the transaction. During the course of the day whilst you move in, we organise the payments and get the conveyance registered.

The only delays you may encounter prior to signing conditions of sale stem from:

  Problems with the title which have to be rectified prior to completion;

  Defects identified by the surveyor which may require further work or      the renegotiation of the price;

  Fulfilling the bank’s criteria for lending; and

  Vendors needing more time in respect of their own move.
